1. Acceptance of Terms

By accessing or using the SIMULORO digital simulation and decision intelligence platform (the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, do not use the Service.

2. Description of Service

SIMULORO provides software infrastructure allowing users to model real-world environments, run scenarios, and analyze potential outcomes. The platform utilizes a compute-credit model based on the complexity of the requested simulations.

3. User Responsibilities & Acceptable Use

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must ensure that any data, including CAD, BIM, or IoT data, uploaded to the platform is owned by you or that you have the necessary licenses to use it.
  • You may not attempt to reverse-engineer the scenario engine, disrupt platform performance, or use the Service for illegal purposes.

4. Simulation Outputs & Disclaimer of Guarantee

IMPORTANT: SIMULORO is a decision-support tool. Our algorithms simulate theoretical scenarios based strictly on the parameters and data you provide.

We do not guarantee that simulation outputs will perfectly replicate real-world events. Assumptions, missing data, and unforeseen physical variables can significantly alter outcomes in reality. You agree that any operational, financial, or engineering decisions made based on SIMULORO outputs are made strictly at your own risk.

5. Intellectual Property

SIMULORO retains all rights, title, and interest in and to the platform, including the simulation engine, UI, and underlying algorithms. You retain all rights to the proprietary data you upload to the platform.

6. Subscription & Compute Credits

Usage of the platform consumes compute credits depending on model complexity (e.g., Simple, Advanced, Complex). You agree to pay all fees associated with your chosen subscription tier and credit usage. Overage fees may apply if your consumption exceeds your allocated tier limits.

7. Limitation of Liability

To the maximum extent permitted by law, SIMULORO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of your use or inability to use the Service.

8. Indemnification

You agree to indemnify and hold harmless SIMULORO and its affiliates from any claims, damages, or expenses arising from your use of the platform, your violation of these terms, or your infringement of any third-party rights.

9. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions.
